Terms of Service

By accessing our website (scalescale.co.uk), booking a call, or entering into an agreement with ScaleScale, you ("Client", "you", or "your") agree to be bound by these Terms of Service. Please read them carefully.

1. Scope of Services

ScaleScale provides done-for-you cold email lead generation and appointment setting services for UK-based web design and development agencies. Our primary service operates on a pay-per-qualified-meeting performance model.

  • We handle campaign strategy, list sourcing, domain infrastructure setup, copywriting, and prospect inbox management.

  • Prospects who request a website redesign or consultation are directed directly to your booking link.

2. Qualified Meeting Criteria & Billing

To ensure total transparency, fees are charged strictly on a per-qualified-meeting basis.

  • Qualified Meeting Definition: A meeting is deemed billable if the prospect:

    1. Shows up to the scheduled meeting on your calendar.

    2. Is a verified decision-maker or key stakeholder (e.g., Director, Founder, Marketing Head) of an active UK business.

    3. Has an expressed interest or active need for website redesign, development, or digital services.

  • Disqualifications & Credit: You will not be charged for any meeting if:

    • The prospect fails to show up (No-Show).

    • The prospect does not meet your agreed-upon target business criteria (e.g., lacks authority or operates in an excluded industry).

    • Disqualifications must be reported to ScaleScale within 48 hours of the scheduled meeting time otherwise you will still be charged.

3. Client Obligations

To ensure optimal campaign performance, the Client agrees to:

  • Provide accurate information regarding their target client profile, minimum project budgets, and service offerings.

  • Maintain an active, updated booking link (e.g., Calendly) with available sales call slots.

  • Attend all scheduled meetings punctually and professionally.

4. Technical Infrastructure & Secondary Domains

  • ScaleScale conducts all cold outreach using secondary, dedicated domain infrastructure owned and operated by ScaleScale.

  • Your primary company domain (youragency.co.uk) is never used for cold sending, ensuring your domain reputation and email deliverability remain 100% protected.

5. Guarantees & Retainers

  • Unless otherwise agreed in a custom commercial agreement, ScaleScale operates with £0 monthly retainers and £0 upfront setup fees.

  • You only pay for qualified sales meetings that take place. Either party may pause or terminate outreach activities at any time with 7 days' written notice.

6. Intellectual Property

All marketing copy, email templates, custom software workflows, and campaign assets developed by ScaleScale remain the intellectual property of ScaleScale. You are granted a limited license to use any lead data provided solely for your internal sales activities.

7. Limitation of Liability

To the maximum extent permitted by UK law:

  • ScaleScale shall not be liable for any indirect, incidental, or consequential damages resulting from lost sales, deal closing rates, or prospective client outcomes.

  • The Client remains solely responsible for closing sales deals, providing agency proposals, and fulfilling web design contracts with introduced leads.

8. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of England and Wales. Any disputes arising under or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
